These Terms of Use (“Terms”) govern access to and use of the FLM Kenya website operated by FULEMAO FLOORING MATERIAL TECHNOLOGY CO., LTD (“FLM Kenya”, “FLM”, “we”, “us” or “our”).

By using the website, you acknowledge that you have read these Terms and agree to comply with them to the extent applicable to your use of the website. If you do not agree, please discontinue use of the website.

The website provides information about FLM, flooring and surface-preparation equipment, tools, consumables, services, technical solutions, projects, training and related business activities. It is primarily intended for users in Kenya but may be accessed from other countries and regions.

If a specific transaction or service is governed by a written quotation, order confirmation, sales or supply agreement, specification, invoice, accepted purchase order or other agreed transaction document, that document governs the relevant transaction. If there is a conflict with these Terms, the specific transaction document prevails for that transaction.

Website content is provided primarily for informational, commercial and educational purposes. You must use the website lawfully and must not interfere with its operation, security or availability or infringe the rights of FLM or any third party.

We take reasonable steps to keep product information accurate and current. Products may nevertheless be updated or improved, and website images, technical data, configurations, accessories, packaging or other details may change.

Images, videos, diagrams and general technical information are primarily for product identification and general description. For a specific transaction, the model, specifications, configuration, quantity, price, delivery terms and other agreed conditions are determined by the final quotation, order confirmation, contract, specification or other transaction document agreed by the parties.

Nothing in these Terms excludes any mandatory obligation to provide accurate product information or any right that cannot lawfully be excluded under applicable Kenyan law.

Submitting an enquiry, Request for Quotation (RFQ), contact form or other message through the website does not by itself constitute a confirmed order, acceptance by FLM, or a binding sales or supply contract.

Unless expressly stated otherwise, general product pages, catalogues, promotional materials and website content are invitations to enquire or negotiate and are not intended by themselves to constitute a final binding offer capable of acceptance without further confirmation.

After receiving an enquiry, FLM may confirm or clarify product model, specifications, quantity, price, currency, taxes, payment terms, availability, delivery, warranty and other commercial terms before a transaction is concluded.

These Terms govern use of the website and do not replace the terms of a specific sale, supply or service transaction. A binding transaction is formed only in accordance with the applicable transaction documents, the parties’ communications and applicable law.

If the website later enables consumers to conclude transactions directly online, any mandatory disclosure, confirmation, correction, cancellation or other rights applicable to internet or remote agreements under Kenyan law will apply notwithstanding these Terms.

The website may contain technical articles, application guidance, demonstrations, training materials, videos, recommendations and information concerning surface preparation, grinding, polishing, cleaning, coatings, concrete treatment, equipment operation and related work.

Such content is provided for general informational and educational purposes. It is not a project-specific engineering opinion, site assessment, design document or guaranteed construction method for a particular project.

Suitability depends on actual conditions including the substrate, concrete, coating, materials, moisture, temperature, environment, equipment configuration, tooling, operator skill and project requirements. Nothing in these Terms excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited under applicable Kenyan law.

Users are responsible for complying with applicable law and these Terms when using the website. If unlawful or improper use of the website causes loss to FLM or a third party, responsibility for that loss will be determined in accordance with applicable law.

Collection and processing of personal data through the website are governed by the FLM Kenya Privacy Policy and, where required, the relevant consent or notice. These Terms do not replace the Privacy Policy.

These Terms and use of the website are governed by the laws of the Republic of Kenya, subject to any mandatory law that applies to a particular user or transaction.

We may update these Terms to reflect changes in law, website functionality, technology or business practices. The revised Terms will be posted with an updated “Last Updated” date. Changes do not retrospectively alter agreed terms of an existing transaction unless permitted by law or agreed by the parties.
